ฟอร์ม 1099-Misc เป็นเอกสารกำกับภาษีสำหรับคนที่ทำงานเป็น independent contractor ไม่ใช่ employee<br />
<br />
นายจ้างส่วนมากมักพยายามเลี่ยงการออก W-2 ให้ลูกจ้าง แต่ให้ 1099-Misc แทน ทั้งๆ ลูกจ้างนั้นมีสถานะเป็น employee ไม่ใช่ independent contractor ทั้งนี้ก็เพื่อเลี่ยงการจ่ายสวัสดิการต่างๆ ให้กับลูกจ้าง อาทิ ประกันสุขภาพ และเงินเกษียณ<br />
<br />
การเสียภาษีของ independent contractor ทำได้โดยการรายงานรายรับทั้งหมด ไม่ว่าจะเป็นเช็ค เงินสด เงินโอนเข้าบัญชี ฯลฯ ข้อดีของการเป็น independent contractor คือคุณสามารถหักค่าใช้จ่ายที่เกี่ยวกับธุรกิจได้ จากนั้นจึงนำส่วนต่างไปคำนวณฐานภาษี<br />
<br />
สิ่งที่คุณต้องเตรียมไปให้คนทำภาษีของคุณคือ งบดุลของปีนั้นๆ ถ้าคุณไม่ได้ทำเอง ก็สามารถจ้างทำได้ มีค่าใช้จ่ายเพิ่มต่างหาก เฉลี่ยที่ประมาณ 35-50/ชม<br />
<br />
เนื่องจาก 1099-Misc ไม่มีการหัก ณ ที่จ่ายภาษีเงินได้ ดังนั้นแทบทุกคนต้องจ่ายภาษีตอนยื่นแบบ หากมีภาษีที่ต้องจ่ายเกินหนึ่งพัน ปีต่อไปคุณจะต้องจ่าย estimate tax เพื่อเลี่ยงการโดนปรับ underpayment penalty<br />
<br />
การจ่าย estimate tax คือการเสียภาษีล่วงหน้าเป็น 4 ไตรมาศ โดยคำนวณจากฐานรายได้เดิม พอถึงสิ้นปีเมื่อยื่นแบบ หากจ่าย estimate tax เกินกว่าภาษีที่ต้องเสียจริง ก็จะได้เงินคืน หากจ่ายไว้ไม่พอ ก็เสียเพิ่มอีกนิดหน่อย แต่จะไม่เสียค่าปรับ<br />

การขอ ITIN <br />
<br />
ทำได้ในกรณีต่อไปนี้คือ<br />
1. คุณมีคู่สมรสที่ถือวีซ่าทำงาน หรือมีใบเขียว และคุณอยู่ในระหว่างยื่นเรื่องขอวีซ่าถาวร หรือ<br />
2. คุณเป็นบุคคลต่างด้าวที่มีรายได้ในอเมริกา เกิน $600.00/ปี คำว่ารายได้ในที่นี้ หมายถึง รายได้ทุกประเภท ไม่ว่าจะเป็นการจ้างงาน ได้จากการพนันในบ่อน ถูกล็อตโต ซื้อขายหุ้นในตลาดหุ้น ค้าขายออนไลน์ผ่านเว็บในอเมริกา เช่น อเมซอน หรือ อีเบย์ หรือลงทุนในกิจการอื่นๆ<br />
<br />
สำหรับ ข้อ 2 <br />
ถ้าคุณมีรายได้จากการลงทุน หรือค้าขายในระยะยาว คุณสามารถขอ ITIN ได้ ถึงแม้ตัวเองจะไม่เคยเดินทางไปอเมริกาเลย<br />
<br />
แต่ถ้าคุณมีรายได้จากแหล่งอื่น ตัวคุณต้องอยู่ในอเมริกาอย่างน้อย 183 วัน ในรอบปีภาษีนั้นๆ เช่น จะยื่นแบบของปี 2019 (กำหนดยื่นคือ มกราคม-เมษายน 2020) ตัวผู้ยื่นจะต้องอยู่ในอเมริกา ในปี 2019 มากกว่า 183 วัน<br />

การขอ ITIN ใช้เวลาประมาณ 6-8 สัปดาห์ และต้องส่งพาสปอร์ตตัวจริงไปพร้อมกับเอกสาร ดังนั้น ถ้าคุณมีแผนเดินทาง อย่าเพิ่งขอ หรืออีกทีหนึ่งก็คือ ทำเรื่องขอให้เรียบร้อยก่อน ได้พาสปอร์ตคืนมาแล้วค่อยเตรียมแผนเดินทาง จะได้ไม่ฉุกละหุก<br />

It allows workers to receive up to six weeks of partial pay each year for time off to care for a seriously ill family member or to bond with a new child (either through birth, adoption or foster care). Workers who take FDTI leave are eligible for up to 55 percent of their wages up to a maximum amount of $728 per week. Participation in this program does not guarantee a job at the end of the leave.</span><br />

<span style="font-family: verdana;"><span style="white-space: pre;">When you file 2018 tax returns next year, your tax return will look </span></span><br />
<span style="font-family: verdana;"><span style="white-space: pre;">different, </span></span><span style="font-family: verdana; white-space: pre;">and because most changes do not happen until then, </span><br />
<span style="font-family: verdana; white-space: pre;">we have some time to learn </span><span style="font-family: verdana; white-space: pre;">and plan for next year. Here are a few </span><br />

<span style="font-family: verdana;"><span style="white-space: pre;">deduction has been eliminated. So this may help you or hurt you. </span></span><br />
<span style="font-family: verdana;"><span style="white-space: pre;">If you have itemized your deductions in prior years, it may or may </span></span><br />
<span style="font-family: verdana;"><span style="white-space: pre;">not be beneficial to itemize in 2018 and beyond.</span></span><br />
<span style="font-family: verdana;"><span style="white-space: pre;"><br /></span></span>
<span style="font-family: verdana;"><span style="white-space: pre;"><b>Increased Child Tax Credit and new Dependent Credit</b>: The credit </span></span><br />
<span style="font-family: verdana;"><span style="white-space: pre;">is increased for each child to $2,000 (up to $1,400 of which is refundable </span></span><br />
<span style="font-family: verdana;"><span style="white-space: pre;">for each child) and each non-child dependent can now receive a new </span></span><br />
<span style="font-family: verdana;"><span style="white-space: pre;">credit of $500. However, you will have no exemption credit or deduction </span></span><br />
<span style="font-family: verdana;"><span style="white-space: pre;">for yourself, your spouse, or your dependents.</span></span><br />
<span style="font-family: verdana;"><span style="white-space: pre;"><br /></span></span>
<span style="font-family: verdana;"><span style="white-space: pre;">The phaseout thresholds for these credits are drastically increased. </span></span><br />
<span style="font-family: verdana;"><span style="white-space: pre;">Married taxpayers filing a joint return can claim the full credits of their </span></span><br />
<span style="font-family: verdana;"><span style="white-space: pre;">adjusted gross income is $400,000 or less ($200,000 for all others). </span></span><br />
<span style="font-family: verdana;"><span style="white-space: pre;">This means many taxpayers will be able to claim these credits in 2018 </span></span><br />
<span style="font-family: verdana;"><span style="white-space: pre;">and beyond.</span></span><br />
<span style="font-family: verdana;"><span style="white-space: pre;"><br /></span></span>
<span style="font-family: verdana;"><span style="white-space: pre;"><b>Disappearing deductions</b>: Beginning with the 2018 tax year, you will </span></span><br />
<span style="font-family: verdana;"><span style="white-space: pre;">no longer be able to deduct:</span></span><br />
<br />
<ul>
<li><span style="font-family: Verdana, sans-serif;">State income tax and property taxes above $10,000 per year in total;</span></li>
<li><span style="font-family: Verdana, sans-serif;">Moving expenses (with exception for certain military);</span></li>
<li><span style="font-family: Verdana, sans-serif;">Employee business expenses such as mileage, travel, entertainment, home office expenses, union dues, tax preparation fees, and investment fees, among others;</span></li>
<li><span style="font-family: Verdana, sans-serif;">Mortgage interest beyond interest on $750,000 of acquisition debt, if you purchase a new home; and</span></li>
<li><span style="font-family: Verdana, sans-serif;">Mortgage interest paid on equity debt (this is no longer deductible for any taxpayers).</span></li>
</ul>

<span style="font-family: verdana;"><span style="white-space: pre;"><b>Some new benefits for individuals</b>: These new benefits include:</span></span><br />

<ul>
<li><span style="font-family: Verdana, sans-serif;">The medical expenses AGI threshold will temporarily drop to 7.5% of AGI for 2017 and 2018;</span></li>
<li><span style="font-family: Verdana, sans-serif;">The AMT threshold is increased, so fewer middle-income taxpayers will be subject to AMT;</span></li>
<li><span style="font-family: Verdana, sans-serif;">The estate tax exclusion has nearly doubled, to $10 million (adjusted for inflation); and</span></li>
<li><span style="font-family: Verdana, sans-serif;">The annual gift tax exclusion remains the same ($14,000 for 2017 and $15,000 for 2018), but the maximum rate on gifts is 35%. </span></li>
</ul>

<span style="font-family: verdana; white-space: pre;"><b>Small business benefit</b>: Beginning in 2018, there will be up tp 20% </span><br />
<span style="font-family: verdana; white-space: pre;">deduction from net business income for a sole proprietorship, LLC </span><br />
<span style="font-family: verdana; white-space: pre;">(excluding those taxed as a C corporation), partnership, S corporation, </span><br />
<span style="font-family: verdana; white-space: pre;">and rental activity that qualify. The rules are incredibly complex, </span><br />
<span style="font-family: verdana; white-space: pre;">and there may be lot of planning in order to maximize this deduction. </span><br />

<span style="font-size: large;">เรื่องจริงที่คนไทยน้อยมากที่จะรู้คือ บ้านหรูๆ ในทำเลดีๆ ในหลายๆ รัฐ คำว่าหรูในที่นี้คือยีสิบล้านเหรียญขึ้นไป เจ้าของนั้นเป็นคนต่างด้าวที่ไม่มีใบเขียวด้วยซ้ำ เขาใช้บ้านในอเมริกาเป็นบ้านพักตากอากาศ หรือเป็นที่พักเวลามาติดต่องาน ฯลฯ ส่วนใหญ่จะเป็นคนที่มาจากประเทศที่ได้รับการยกเว้นวีซ่า หรือมีวีซ่าสิบปีเป็นต้น อเมริกาไม่มีกฏหมายห้ามคนต่างด้าวถือครองที่ดิน อสังหาฯ เพียงแต่โครงสร้างภาษีจะแตกต่างกับคนที่เป็นพลเมืองค่ะ </span><br />

แล้วก็หนังสือมือสองที่ตัวเองไม่ได้ใช้แล้ว พอมาต้นปี 2012
เพื่อนคนนึงเห็นว่ามีร้านบนอเมซอนอยู่แล้ว ก็เลยเอาของมาฝากขาย
โดยให้ค่าตอบแทนเป็นเปอร์เซนต์ ปรากฏว่าขายดีมาก Gross income ของร้านคือ
$50,000 มีคืนของกับรีฟันด์ $4,000 <br />

เมื่อเดือนมกราคม 2013 ผมได้รับ 1099-K จากอเมซอน
และในรายละเอียดแจ้งด้วยว่าผมต้องยื่น Schedule C
ซึ่งผมไม่เข้าใจว่าต้องทำยังไง นอกจากนั้นผมยังได้รับ 1098-T
จากทางโรงเรียนด้วย<br />

ไม่ว่าจะเป็นลูกจ้างของกิจการหรือบุคคลธรรมดา แต่ที่ไม่ห้าม คือ

Kristof<br /><br />Personal Finance<br />5:56 PM PST, February 18, 2012<br /><br /><br />The constantly changing tax code presents challenges to nearly everyone, but Californians face particularly vexing issues thanks to both the state's unique tax system and a combination of economic and demographic trends.<br /><br />Consider the fate of the Golden State's 65,000 domestic partners. Most Americans can file a federal return and expect that their answers on the key lines showing earnings and filing status to be consistent on both federal and state forms. Not domestic partners.<br /><br />They must file joint returns in California and file separate returns — following a complex formula to split joint income — with the federal government.<br /><br />"It's a nightmare," said Joe Calderaro, technical research specialist with the California Society of Enrolled Agents.<br /><br />Capital gains? You claim a preferential rate on federal returns, but not on state returns. Worse, this disparity in tax rates can trigger an additional federal horror called the alternative minimum tax.<br /><br />Then there are demographic trends — like children and parents moving in with other adult relatives to save on expenses in today's still-tight economy — which force careful review of the sometimes Byzantine rules that determine who can be claimed as a dependent.<br /><br />Here's a thicket of sticky tax situations facing California residents and how you can best deal with them this filing season.<br /><br /><b>Merged families</b><br /><br />Blame better communication — or coddling — but you're almost twice as likely to have an adult child living with you today as you were in 1970, according to the Census Bureau. More than 18% of men between the ages of 25 and 34 and nearly 10% of women in that age group are living with Mom and Dad. Grandma may be part of the household too.<br /><br />Although this trend toward cohabitation has been sweeping the country, nowhere is it more prevalent than in the Golden State, where the unemployment rate and living expenses are unusually high. For instance, 9% of Californians over the age of 65 are now living in the home of another family member versus 6% nationwide. That accounts for roughly 400,000 California seniors.<br /><br />At tax time, merged households raise the question: Are these semi-permanent guests deductible dependents? There are numerous tests to figure the answer. However, for adults who are capable of self-care and no longer in school, the toughest test to pass is based on income, IRS spokesman Eric Smith said. If adults living with you earn more than the exemption amount of $3,700 in 2011, they normally cannot be claimed as dependents, even if you're paying more than half of their support.<br /><br />It's important to note that Social Security and welfare income doesn't count. So if a grandparent gets $25,000 in Social Security and nothing else, he or she could be claimed as a dependent. But if that same grandparent collected $3,800 in investment income, he or she could not be claimed as a dependent. When income is flexible, pay attention to the threshold. A few extra dollars pulled out of a retirement account could cost a dependency deduction, which could save a family paying a 30% tax rate a cool $1,110.<br /><br /><b>Use tax</b><br /><br />Are you an Amazon.com addict? If so, you might need to take a close look at something called "use tax." Use tax essentially replaces the sales tax that you didn't pay on a purchase made from an out-of-state retailer. It has been in effect since the 1930s, but few people had to worry about it until the Internet age, when online sales became ubiquitous.<br /><br />There are two ways to calculate your liability. You can either cobble together all the purchases you made out of state and online, review whether sales tax was imposed and, if it wasn't, calculate the use tax based on the sales tax rate in your county. Or you can take the easy way out and use the tax table that determines your liability based on your income. If you earn less than $20,000, your use tax would be $7. But if you earned between $150,000 and $200,000, this method assumes you'd owe $123. Earn more than that and the safe-harbor method assumes that you owe 0.07% of your adjusted gross income.<br /><br /><b>Domestic partners</b><br /><br />Tens of thousands of individuals have registered with the state of California as domestic partners or entered into same-sex marriages before the passage of Proposition 8. The state demands that they file joint tax returns with the Franchise Tax Board. However, the federal government doesn't recognize these partnerships, so these same taxpayers will need to file as "single" on federal returns.<br /><br />Simple enough? Not so fast. Because California is a community property state, any income that would be considered community property is supposed to be split on federal returns.<br /><br />So if Sue and Jane are domestic partners and earn $50,000 and $75,000 respectively, they would file a joint California return reflecting their $125,000 in gross income. But their two federal returns would each claim $62,500 in wages — $25,000 to reflect half of Sue's $50,000 and $37,500 for half of Jane's $75,000.<br /><br />Whether they would need to split investment, gift and other income — not to mention itemized deductions — depends on the type of income and deduction, Calderaro said. You can't assume that tax software programs will do it right, he added. The federal government puts out Publication 555 to help determine how domestic partners should treat community property, but Calderaro's advice is simpler: "Use a qualified tax preparer."<br /><br /><b>Real estate losses</b><br /><br />In California, there were more foreclosures and short sales — in which a home is sold for less than the amount owed on the mortgage — than in any other state in 2011, said Daren Blomquist, vice president at RealtyTrac in Irvine. Distressed sales accounted for roughly 40% of all real estate transactions in the Golden State last year, affecting more than 200,000 taxpayers.<br /><br />These sales are likely to result in a disconcerting notice from lenders, showing the amount of discharged debt as income. Thanks to the Mortgage Relief Act of 2007, this phantom income is not taxable. But anyone receiving a 1099 form for discharged debt will need to fill out an additional tax form called the 982. If the forgiven mortgage debt exceeds $500,000, some of it could be subject to California tax.<br /><br /><b>Home sales</b><br /><br />If you were among the lucky few Californians able to sell your house at a profit — or you enjoyed significant investment gains — there are more complications. Both federal and state laws allow taxpayers to exclude $250,000 per person or $500,000 per couple in net proceeds from the sale of a principal residence. But any additional profit would be subject to capital gains taxes on federal returns, and ordinary state income taxes on California returns. That's the simple part.<br /><br />What's complicated is something called the alternative minimum tax, which can be triggered when you pay (and deduct) significant state income taxes on a federal return. If you have substantial capital gains, several small children, extremely high property taxes or miscellaneous business expenses, you'll have to calculate your federal tax twice: once under the ordinary system and again under the alternative minimum tax system. You pay whichever calculation comes up with the higher tax obligation. *คู่สมรสที่ยื่นแบบภาษีร่วมกัน คนหนึ่งมีอายุเกิน 65 ปี และมีรายได้รวมต่ำกว่า $19,800/ปี<br />
*คู่สมรสที่ยื่นแบบภาษีร่วมกัน อายุเกิน 65 ปีทั้งคู่ และมีรายได้ต่ำกว่า $20,900/ปี<br />

แต่ทั้งนี้ก็ยังมีเงื่อนไขว่าคุณต้องยื่นแบบภาษีถึงแม้ว่าจะมีรายได้ต่ำกว่าเกณฑ์กำหนด ถ้าเข้าข่ายข้อหนึ่งข้อใดต่อไปนี้ คือ<br />
<br />
*คุณมีคุณสมบัติที่จะได้รับ tax refund เช่น คุณทำงานเป็นลูกจ้างในระหว่างปี และนายจ้างได้หัก ณ ที่จ่าย นำส่ง IRS และ State <br />
<br />
*คุณมีสิทธิได้รับ earned income tax credit (EITC) ซึ่งเป็นเครดิตที่รัฐบาลช่วยเหลือผู้มีรายได้น้อย<br />
<br />
*คุณทำกิจการของตนเองและในระหว่างปี คุณมีรายได้เกิน $400/ปี<br />
<br />
*คุณค้างจ่ายภาษีอื่นๆ หรือคุณค้างจ่ายภาษี Social Security and Medicare tax เช่น คุณไม่ได้แจงภาษีในส่วนรายได้ที่มาจากทิป เป็นต้น<br />
<br />
นอกจากนั้นยังมีเหตุผลอื่นๆ ที่คุณจะต้องยื่นแบบภาษี ถึงแม้ว่าจะมีรายได้ต่ำกว่าเกณฑ์มากๆ ก็คือ หากคุณกำลังจะยื่นขอใบเขียว หรือทำซิติเซ่น ทั้งตัวคุณ และสปอนเซ่อร์ของคุณจะต้องมีหลักฐานการเสียภาษีย้อนหลังสามปี <br />

A: ประเด็นนี้เป็นปัญหาหลักอย่างหนึ่งของคนทำงานร้านอาหาร โดยเฉพาะอย่างยิ่ง คนที่ไม่มีใบอนุญาตทำงานอย่างถูกต้องมักประสบบ่อยๆ คือถูกนายจ้างโกง ดิฉันเคยเจอประเภท รับนักเรียนมาทำงาน แต่ไม่ให้ค่าแรงรายชั่วโมง ให้รอแบ่งทิปอย่างเดียว หรือให้ค่าแรงแต่ต่ำกว่าเกณฑ์ เช่น $8.00/ชม+ทิป ก็จ่ายแค่ $2.50/ชม+ทิป ซึ่งร้านก็ไม่ได้ขายดีมากมาย <br />
<br />
ในชิคาโก ค่าแรงขั้นต่ำสำหรับงานที่มีรายได้จากทิปด้วยคือ 4.95/ชม + ทิป ดังนั้นรายได้ในส่วนนี้ของคุณถูกต้องแล้วนะคะ ส่วนรายได้จากทิปเป็นรายได้ที่ต้องเสียภาษี แต่วิธีการสำแดงรายได้นั้นขึ้นอยู่กับเจ้าของกิจการ และขึ้นอยู่กับว่าคุณจะตกลงกันอย่างไร เช่น<br />
<br />
* ให้คุณเป็นเงินสด คุณไปจัดการเรื่องภาษีส่วนนี้เอาเอง นายจ้างออก W-2 ให้เฉพาะในส่วนค่าแรงรายชั่วโมง หรือ<br />
<br />
* ให้คุณเป็นเงินสด ไม่หัก แต่เวลาออก W-2 เขาจะระบุลงไปด้วยว่ารายได้รายชั่วโมงของคุณเท่าไหร่ รายได้จากทิป เท่าไหร่ หรือ<br />
<br />
* ให้คุณเป็นเงินสด แต่ทำรายการหักเรียบร้อย วิธีนี้ใน W-2 จะมีรายการหัก ณ ที่จ่ายที่นำส่ง IRS ให้ชัดเจนทั้งสองรายการ <br />
<br />
ถ้าลูกค้าจ่ายทิปด้วยเงินสด นายจ้างไม่มีสิทธิหักเงินทิป 3% หรือ 2% อย่างที่คุณว่ามานะคะ<br />
<br />
อัตราภาษีที่หัก ณ ที่จ่าย โดยทั่วไป รวมแล้วตกที่ประมาณ 25% ของรายได้รวม (Federal tax + Social Security + Medicare + State tax) ดังนั้นเป็นไปไม่ได้ที่คุณจะได้รับเช็คเป็นศูนย์<br />
<br />
ถ้าคุณมีหลักฐาน เช่น การบันทึกเวลาเข้าออก ยอดทิปที่นับได้ในแต่ละวัน และหลักฐานอื่นๆ หรือเพื่อนร่วมงานที่ประสบชะตากรรมเดียวกัน แนะนำว่าให้ทำตามขั้นตอน คือ รวมตัวกันเจรจากับเจ้าของร้าน ถ้าไม่ได้ผลหรือเพื่อนไม่เอาด้วย ให้นำพยานหลักฐานทั้งหมด ร้องเรียนต่อ Labor Department ในเคาน์ตี้ที่คุณอยู่ ไม่ต้องใช้ทนายค่ะ<br />

ประเด็นที่จะพูดถึงวันนี้คือ ลูกจ้างที่เป็นคนไทยหลายๆ คน พอสิ้นปียื่นแบบภาษี พอได้เงินคืน ต้องเอาไปคืนให้นายจ้าง อันนี้ไม่ถูกนะคะ<br />
<br />
ในฐานะลูกจ้าง ปกติแล้วเมื่อคุณทำงาน จะรับค่าจ้างจะเป็นต่อวีคหรือต่อเดือนก็ตาม รายได้ของคุณจะถูกหักตามอัตราส่วนดังนี้คือ<br />
<br />
1. ภาษีเงินได้ของรัฐบาลกลาง 10%-35% ขึ้นอยู่กับรายได้ว่ามากน้อยแค่ไหน เช่น ถ้าคุณมีรายได้ต่ำกว่าหนึ่งหมื่นหกร้อยเหรียญต่อปี เป็นโสด คุณจะถูกหัก ณ ที่จ่าย 10% ถ้าเกินนี้ แต่ต่ำกว่าสามหมื่นหกพันหกร้อย คุณจะถูกหัก ณ ที่จ่าย 15% เป็นต้น<br />
<br />
2. เงินโซเชี่ยล 6.2 %<br />
3. เมดิแคร์ 1.45 %<br />
4. ภาษีเงินได้ของรัฐ ตั้งแต่ 1% ถึง 12% ขึ้นอยู่กับรายได้ว่ามากน้อยแค่ไหน<br />
<br />
จำนวนเงินที่หัก ณ ที่จ่ายนี้ขึ้นอยู่กับสถานะของคุณด้วยว่ามีการเปลี่ยนแปลงหรือไม่ ดังนั้นจึงควรอัพเดท W-4 ให้เป็นปัจจุบันทุกหกเดือน เพื่อที่คุณจะได้ไม่ถูกหักมากเกินไป หรือถูกหักน้อยเกินไปจนต้องไปจ่ายเพิ่มตอนปลายปี นายจ้างเมื่อหักภาษีจากเงินค่าจ้างของคุณ จะต้องนำส่งให้ IRS และนายจ้างจะต้องออก W-2 ให้คุณเป็นหลักฐาน ทุกคนจะต้องได้รับ W-2 ภายในวันที่ 30 มกราคม<br />

พอสิ้นปี คุณต้องยื่นภาษี หรือที่เรียกกันว่าทำ Tax Return การยื่นแบบภาษีเป็นการยืนยันจำนวนภาษีที่คุณต้องเสียจริงในรอบปีภาษีนั้นๆ ถ้าคุณหัก ณ ที่จ่ายเอาไว้น้อย คุณก็จะต้องจ่ายภาษีเพิ่ม แต่ถ้าคุณหัก ณ ที่จ่ายเอาไว้มากกว่าความเป็นจริง คุณก็จะได้รับเงินคืน <br />

<b>เงิน Tax Return ที่คืนมานี้เป็นเงินของคุณ มาจากจำนวนที่เขาหักจากรายได้ที่คุณได้รับในแต่ละงวด ไม่ใช่เงินของนายจ้าง ดังนั้นคุณไม่ต้องนำไปคืนให้นายจ้าง ถ้าหากนายจ้างของคุณสั่งว่าต้องเอามาคืน แนะนำว่าให้ร้องเรียนไปที่สำนักงานของกระทรวงแรงงาน ในเคาน์ตี้ที่คุณทำงานอยู่ค่ะ</b><br />

<span style="background-color: transparent; color: black; font-family: Arial; font-style: normal; font-variant: normal; font-weight: normal; text-decoration: none; vertical-align: baseline;">W-8BEN คือ Certificate of Foreign Status of Beneficial Owner for United States Tax Withholding หรือภาษาชาวบ้านคือหนังสือรับรองสถานะว่าผู้รับเงินเป็นคนต่างด้าว ซึ่งทำให้ไม่ต้องหัก ณ ที่จ่าย Federal Income Tax, Social Security, Medicare และ State Tax ดังนั้นคุณจะได้รับค่าจ้างเต็มเม็ดเต็มหน่วย ไม่โดนหักภาษี ณ ที่จ่ายประมาณ 20% เหมือนพลเมืองอเมริกัน</span><br />

<span style="background-color: transparent; color: black; font-family: Arial; font-style: normal; font-variant: normal; font-weight: normal; text-decoration: none; vertical-align: baseline;">การทำ W-8BEN หนึ่งครั้งมีผลบังคับใช้สามปี ยกเว้นถ้าคุณเกิดไปเรียนต่ออเมริกา หรือได้ใบเขียว หรือได้วีซ่าทำงาน หรือมีเหตุให้ต้องอยู่ในอเมริกาเกินกว่า 183 วันในปีนั้นๆ ระยะเวลาช่วงที่คุณอยู่ในอเมริกาคุณจะต้องเสียภาษีตาอัตรา resident แต่เมื่อกลับเมืองไทยแล้วก็สามารถทำ W-8BEN ใหม่ได้</span><br />

<span style="background-color: transparent; color: black; font-family: Arial; font-style: normal; font-variant: normal; font-weight: normal; text-decoration: none; vertical-align: baseline;">ถ้า คุณมีเงินได้ในส่วนนี้เกิน $600 ต่อปี พอสิ้นปีคุณจะต้องยื่นแบบภาษีต่อ IRS แต่เนื่องจากสถานะเป็นคนต่างด้าวที่ไม่ได้อยู่ในอเมริกา หรืออยู่ในอเมริกาน้อยกว่า 183 วันต่อปี คุณจะได้ tax credit คือไม่ต้องเสียภาษีในส่วนนี้ แต่ต้องยื่นแบบภาษีตอนสิ้นปี</span><br />

<span style="background-color: transparent; color: black; font-family: Arial; font-style: normal; font-variant: normal; font-weight: normal; text-decoration: none; vertical-align: baseline;">ถึงตรงนี้หลายคนอาจจะสงสัยว่า ถ้าไม่ยื่นจะเป็นอะไรมั้ย ถ้าจำนวนเงินน้อยคือปีละไม่กี่พันเหรียญ ตรงนี้ไม่มีปัญหาค่ะ แต่ถ้าเป็นเงินจำนวนเกินหนึ่งหมื่นเหรียญต่อปีหรือมากกว่านั้น คุณจะได้รับจดหมายทวงถามจาก IRS ค่ะ</span><br />
<br />
<span style="background-color: transparent; color: black; font-family: Arial; font-style: normal; font-variant: normal; font-weight: normal; text-decoration: none; vertical-align: baseline;">ถ้าคุณได้รับจดหมายทวงถามจาก IRS อย่าเพิกเฉย หรือคิดว่าคุณอยู่เมืองไทย รัฐบาลอเมริกันคงจะทำอะไรคุณไม่ได้ อังเคิลแซมไม่สามารถก้าวข้าม jurisdiction มาถึงเมืองไทยได้ก็จริง แต่ที่เขาจะทำคือ ถ้าหากคุณยังมีรายได้จากการขายภาพของคุณ IRS จะยึดเงินจำนวนนี้ไปหักหนี้แทน (เงินภาษี+ดอกเบี้ย+ค่าปรับชำระล่าช้า)</span><br />

The 2011 tax season is under way and the airwaves are full of a deal that sounds too good to be true: For another month, Americans can visit their local H&R Block (NYSE:HRB - News) office and file their taxes for no charge.<br />
<br />
How and why would the nation's largest tax filer give its service away for free? In a nutshell: 1) H&R Block is being forced to scramble harder this tax season to compete with other filing services. 2) It's unable to offer a service that brought in customers in years past. 3) The "free taxes" offer isn't for everyone.<br />
<br />
Here are the details:<br />
<br />
<b>What's the Catch?</b><br />
The promotion only covers those filing the 1040EZ federal form, which is about 16 percent of H&R Block customers. The 1040EZ form covers only the very simplest tax issues. It can't be used by anyone who has dependents, makes more than $100,000 per year, is age 65 or older, claims adjustment to income like alimony or tuition deductions, or itemizes deductions. Thus, homeowners who deduct mortgage interest or people with large charitable contributions can't use the 1040EZ.<br />
<br />
Even those customers who can use a 1040EZ will have to pay H&R Block extra to file any state income tax returns. Just seven states -- Alaska, Florida, Nevada, South Dakota, Texas, Washington, and Wyoming -- have no income tax.<br />
<br />
The offer began on Jan. 14, when H&R Block's local offices started filing 2010 returns, and ends on Feb. 15. From Feb. 15 to Apr. 18 (the tax filing deadline is different this year because of a holiday on Apr. 15 in the District of Columbia), customers will be charged to file a 1040EZ at an H&R Block office. That's an important consideration for taxpayers who may still be waiting for key end-of-the-year paperwork.<br />
<br />
<b>What Does H&R Block Get Out of the Promotion?</b><br />
<br />
The free returns aren't a charity project, even if many of H&R Block's early filers tend to be poorer people who want their tax refunds as soon as possible. "It's not about giving away business for free," says Amy McAnarney, H&R Block's senior vice-president for tax operations. One goal is to increase foot traffic at H&R Block offices. " 'Free' can be a very powerful word," she says. Until they arrive for their appointment, many of these new customers might not realize they actually need more complex tax forms -- and thus will wind up paying for them.<br />
<br />
Another goal is to attract younger taxpayers -- those who can still use the 1040EZ -- and win their loyalty in future years. The company estimates 55 percent of EZ filers will need to file a more complex form within two years.<br />
<br />
<b>Why This Year?</b><br />
<br />
H&R Block's retail operation has been losing customers, with retail returns falling 6.1 percent last year. Morningstar (NasdaqGS:MORN - News) senior equity analyst Vishnu Lekraj says in-office tax preparation services continue to lose market share to tax software and websites, which can be much cheaper. "The taxpayer is becoming more and more comfortable doing their own taxes," he says.<br />
<br />
Many software or online tax tools have already offered 1040EZ filings for free, including those from H&R Block and Intuit's (NasdaqGS:INTU - News) TurboTax. Last year, McAnarney says, H&R Block tried offering free 1040EZ returns in offices in three cities -- Miami, New Orleans, and Atlanta -- "and it was received very well."<br />
<br />
Offering free returns is also part of the company's effort to bounce back from some rough years, analysts say. A rise in unemployment has hurt business for all tax preparers, with industrywide IRS filings dropping 1.7 percent last year, the largest decline since 1971.<br />
<br />
<b>What Happened to H&R Block's Advertising Promotion of Previous Years, the "Instant Money" Refund?</b><br />
<br />
Those "refund anticipation loans" have come under fire by the federal government and consumer groups for high fees and finance charges. Compass Point equity analyst Mike Turner estimates RALs cost H&R Block's 2010 customers about $67 each, which works out to an annualized interest rate of 54 percent on an average $3,000 refund. The pitch by H&R Block and other services has been that RALs let customers -- generally those who lack bank accounts -- get their refunds immediately, rather than waiting eight weeks or more to get a check from the IRS.<br />
<br />
After regulators started cracking down, H&R Block's lender, HSBC (NYSE:HBC - News), announced it wouldn't fund the company's Instant Money program this year. As a result, H&R Block can't offer RALs, while competitors like Jackson Hewitt (NYSE:JTX - News) still can do so, at least this year. Regulators seem serious about ending RALs entirely, Morningstar's Lekraj says, adding: "They just feel consumers at the end of the day are getting taken advantage of." Compass Point's Turner estimates H&R Block could lose 10 percent to 15 percent of its RAL users. H&R Block will offer alternatives, including a prepaid debit card and a refund anticipation check that can take eight days to clear. But the free tax service is designed to pick up some of the promotional slack.<br />
<br />
<b>Won't This Eat into H&R Block's Revenue?</b><br />
<br />
H&R Block is confident that many of those new customers who enter offices looking for a free return will end up paying anyway -- for more complex federal returns, for state returns, or for other services. Last year the average tax return at an H&R Block retail office cost $189, and executives don't expect that to decline in 2011. "Our ability to monetize this program means a minimal impact on our net average charge," H&R Block Retail Tax President Phil Mazzini told analysts on Dec. 7.<br />
<br />
The high U.S. jobless rate, the cancellation of the Instant Money program, and the free filing promotion all make it difficult to predict how well the company will do this tax season, analysts say. "Everything is really up in the air in my opinion," Morningstar's Lekraj says.<br />
<br />
Compass Point's Turner expects H&R Block will stop losing business to the bad economy, but says it will continue losing customers to do-it-yourself, computerized tax filing options. "I would expect their total filers to be down slightly year over year," he says.<br />
<br />
Management is offering no guidance to investors. Analysts surveyed by Bloomberg estimate revenues will fall 1.4 percent, to $3.7 billion, in the 2011 fiscal year ending in April, following a 4.5 percent decline last year. Net income is estimated to fall 2.1 percent, to $469 million, after a 1.3 percent drop in 2010.<br />
